    National City has been calling ona daily basis sometimes 6 times a day.  We filed bankruptcy but they still keep calling.

    They also call within 7-9 minutes if they don't get an answer...this is an FDCPA violation.  I've just reported them to the FTC.  I've asked them to stop calling because I'm working with someone to settle the debt, they say that they can not because it's in the computer!  Well, I work for a collection company, I know you can!  Nice try...

    I just got a call from National City from this number. It left a message telling me to go to a website or call the 866-622-2657 and select option 5.I am pretty sure they are trying to get people to pay twice by accident and/or to incur the $15 fee for using speed pay.They have our boat loan which has been paid on time way before the late date every month since it originated in July 2004. Since I have this set up to automatically pay from my checking (originated from my end, not theirs) I quickly checked my bank account and the payment had cleared my account on 3/5. Today is 3/6. National City's website instructed me to pay my bill and a $15 fee would be tacked on for Speed Pay. ARE THEY KIDDING--$15--someone is taking a nice slice out of the fee.I spoke to the rep who asked me if I wished to make my payment now. SHE ALSO ASKED FOR MY CELLPHONE NUMBER WHICH OF COURSE I REFUSED. I told her the payment had cleared my account yesterday. I told her I was ticked off that our account that is never late was being chased for payment. She told me that technically it is due on the 1st so it is late as of the 2nd but no late fee is assessed until the 10th. I said ok, in that case since you all are so on top of things, why do I no longer get paper statements even though I did not request to have them stopped. She told me she could not help me with this.I was neutral about this bank until today. I called their customer service office to find out why I no longer received the statements and they told me they have my address flagged as no good. It was in fact my correct address the one they verified with me.I think this bank has been in trouble and this collection stuff is all about getting money the sneaky way. Now they are part of PNC. We have an account there and if they start acting like this that will be the end of that.

On Dec. 19, National City Mortgage agreed to pay 2,859 of its West Virginia customers for allegedly refusing to credit a partial payment or charging more than one late fee for the same late payment.National City does not admit guilt in the settlement, but the company has agreed to pay a penalty of $700,000, including $151 for each refused payment or duplicate late fee. More than 60 customers with multiple infractions will receive at least $1,000."National City will not be doing those things in the future in West Virginia," said lawyer John Barrett of Charleston law firm Bailey and Glasser.The 2007 suit accuses National City of failing to credit payments and charging illegal late fees, as well as "harassing and abusive debt collection practices." The settlement became final earlier this month in the U.S. District Court in Charleston, in a hearing before Judge John Copenhaver.According to the West Virginia Consumer and Credit Protection Act, a lender must credit any amount a borrower pays on a mortgage. Under the same act, a company may charge only one late fee for a late payment."West Virginia law is specific on these points," Barrett said.The National City settlement joins a list of similar West Virginia settlements of lawsuits against national mortgage companies. Since 2004, Charleston public interest law firm Mountain State Justice has won settlements of lawsuits against six major mortgage servicers. In every case, said attorney Bren Pomponio, the companies were refusing to credit payments and charging illegal late fees, among other things."That may sound like a small thing," he said, "but, especially for somebody on limited income, it can lead to foreclosure proceedings."In September, National City attorneys moved to dismiss the lawsuit, arguing that federal law trumps West Virginia law, and their actions were legal under federal law, which is less stringent."Congress specifically enacted protections to ensure that national banking associations could, free from state intrusion, engage in 'all such incidental powers as shall be necessary to carry on the business of banking,'" National City attorneys wrote.But National City management elected to settle the case.Duplicate late fees will be erased, Barrett said. Un-credited partial payments are harder to remedy, he said, "because they can throw a person into foreclosure."Aggressive, rude callsThe lawsuit was filed in June 2007 on behalf of Charleston resident James Muhammad and 2,858 other West Virginians "to prevent [National City] from needlessly and illegally placing their home loans into default and possible foreclosure," according to the legal complaint."I am very relieved that this case is settled," said Muhammad, who is program director for West Virginia Public Radio. "I have never sued anybody before in my life." "James Muhammad gave people he didn't know a real gift by standing up for his rights," Barrett said. "It began as a small issue for me, but it became clear to me that these practices were leading to very serious problems for other people," Muhammad said. "And I just thought, well, if somebody doesn't do something, it will just keep happening. "This whole thing did start in a pretty ordinary way," he said. In early October 2005, he mailed his monthly payment to National City Mortgage. "I grabbed the wrong coupon," he said. National City told Muhammad they would not credit his payment because it was $28.48 short.So he mailed them the $28.48, along with the next month's payment, according to the legal complaint."I had made a simple mistake. I corrected it. I thought that would be the end of it," he said. But National City Mortgage mailed his original payment back, according to the legal complaint, and declared him in default.He began to receive "daily, aggressive, rude phone calls" from National City at home, he said.He made all subsequent payments on time, the suit says, but the company still charged him a new late fee each month for more than a year. He tried repeatedly to straighten it out, he said, "but they were very aggressive and difficult to deal with. You'd say you sent them money, and they'd say they didn't have it. But after you produced a canceled check, they'd say, 'Oh, we found it!'"National City is not the only company that refuses to credit payments or charges unnecessary fees," Barrett said, "but you will not find local West Virginia banks doing this kind of thing. It's always an out-of-state lender." West Virginia-chartered banks are governed primarily by stricter state law.Refusal to credit payments involves hundreds of dollars, but the late fee is only about $15, Barrett said. But when it is multiplied by thousands, sometimes tens of thousands, it can amount to considerable money for the company, he said. "These unnecessary fees are not often challenged because the amounts involved are not high. Really, this case is a great illustration of why class actions are so important to consumers when you have high-volume, low-dollar illegalities."Muhammad said he has read the legal issues involved, "but the thing that disturbed me most was the level of disrespect the company showed their clients. I thought, OK, I'm just not going to take this."The odd thing is, a simple apology on a piece of paper would have done it for me," he said. "I always wanted to believe you could resolve most issues out of court with a company."National City's attorney in Charleston - Bryant Spann at Allen Guthrie McHugh & Thomas - said the company declined to comment for this story.National City Mortgage's decision to settle may have been influenced by the fact that the company is also contending with other lawsuits, including suits from its own stockholders who allege that company management misled them about the extent of the company's sub-prime mortgage problems.In the past year, the company has cut dividends by almost half, shut down its wholesale business and laid off at least 1,700 employees, according to filings in the stockholder suits.Reach Kate Long at http://wvgazette.com/News/contact/xngrybat jitnmrggr pbz

    This place calls and calls and calls. I've gotten into several arguments with them and they never let me speak with a manager. They are calling for my husband who is at work! They call all day, it's computer generated and the thing calls up to 10 times a day! It's harassment!

    this bank is dispicable.  National City B ank.  They call all hours of the day saturdays and sundays, never ending   8 tmes a day it seams.  They continue in spite of asking them not to.  I would never do any business with them again.  Call and have the number blocked by the phone company.Set up your computer to call their customer service Dept with a recorded message that is very long  to waste lots of their time and end with a request to never call you again.

    I have received as many as 8 calls in one evening from this number; however, it comes up on my caller ID as unknown, at first. My kids know not to answer an unknown number, so sometimes the number would call again right away. I didn't even know where this number was coming from until I looked at my call log and saw the actual 866 number. This is a very bad business practice. This is harrassment from a large banking institution that should be a little bit more concerned with their image and how they're perceived...word of mouth goes very far in this day and age. I could see being a little bit more aggressive with collection practices once a customer is more than one payment past due, but to receive that many repeated calls with no message before the grace period or before month's-end is completely unnecessary.

    They called me last year and today again about my mortgage with Natinal city. They asked me to cancel my check with this month for mortgage and paid over the phone (mortgage plus $15). I suspect that they have my check and want me to more, and do this on purpose.

    It hasn't stopped and it's getting worse. i just cussed the lady out after they called me 9 times today!!! It's been showing up on the caller id unknown caller. I see they are letting go of 4000 people. Hopefully it's these annoying people who harrass me!!!

    I have co-signed on a car for my daughter 4 years ago. Seems just in the past year they have been calling both of us and harrassing us. She has a due date and a grace period. They start calling us 2 days before due date. I asked someone from my local branch and they said it's not late until the grace period when you have to pay the extra charge. I also told them if this didn't stop I would no longer bank with them. It did stop for a few months but has started up again this week.I'm 50 so I get free checking now, but I will never ever use them for another vehicle loan

    I don't think that this number is actually National City. I first started getting calls from 800-544-3623 and then the next day, this number. They both call at least 3 times a day and never leave messages. When I looked up that number, it was also "National City." I don't know how these people got my phone number or what they want, but a bank would not call to ask your account info. I think these are scammers.

    Very annoying, if they'd leave a message it'd be trivial to get back to them. But as it is, they don't leave a message and you can't just call them back. Also, they don't answer on their end of the call right away. Ring, ring, you pick up - 30 seconds later they talk. Very annoying!
