Leave a CommentJust got a call from this Scampany. I asked if he was soliciting anything. He clearly said no, and that he just wanted to give me some information for my benefit. Yeah right. Seemed like he used to be a used car salesman in a former life, as it was high pressure sales tactics. Well, didn't work on me. I played with the idiot a bit, them finally he just got frustrated and ***g up. Do NOT give them any personal info, as they just want your money for a tax issue that you may have.
These guys are frauds and dangerous. Give them nothing. Be polite and **** up.
Got a call from Berkshire...anyone who receives calls from them actually has (or had) a lien, but the IRS files liens to protect themselves. These crooks try to make you believe that liens are the same as levies, seizures, etc. Even after I explained that I was making payments to the IRS, it didn't matter to them. I hope they go down soon.

Remember that Federal law and most state telemarketing laws provide a private right of action for violations of telephone solicitation laws. You can sue in small claims court.You can sue Berkshire for unsolicited calls ($500 minimum damages for each call when your number is registered with your state do-not-call list or the national do-not-call registry, up to $1500 for each subsequent violation), for failing to remove you from its call list ($500 minimum damages up to $1500 for each subsequent violation), for failing to provide you a written copy of its written do not call policy on demand (at least $500 fine for first violation, up to $1500 for each subsequent violation).I strongly encourage everyone who has ever been harassed by Berkshire (or any of its sister companies) to:1) Contact Berkshire to exercise your rights under your state's law and federal law (request to be placed on no call list, request copy of do-not-call policy, etc.)2) File complaints with the appropriate state and federal authorities (FTC, FCC, state Attorney General, other state agency) especially if the company would not place you on its no-call list or provide you with a copy of its written do-not-call policy3) Send a demand letter stating violations (cite the applicable state and federal laws) and damages for each violation4) File suit in small claims (or other appropriate court) if Berkshire does not settle.
Brookshire Financial Partners( Don Moore) called claiming that he needed to talk with us about a federal income tax issue and we needed to call him back ASAP or the IRS would s**** garnishing our wages.First off, IF we owed the IRS we would be contacted by the IRS not Don Moore at Brookshire Financial Partners. WE DO NOT owe the IRS or Brookshire ...do not even know of them. This was the first and last call that better be on my answering ma****e from Don Moore or Brookshire.

They have been calling 5 to 6 times a day, disturbing my business.When I ask to put into their no calling list, they say that it will take 2 weeks.

The national pandemic of telephone terrorism perpetrated by desperate criminal collection agencies is because they are trying to terrorize people who are naive enough to answer and submit to unsolicited telephone calls or written "collection" letters that have no legitimate legal debt****ociated with them (a.k.a. "zombie debts") or with any of the companies, universities, or whomever else they claim to represent. Because most "little guys" were bankrupted by the criminal Wall St/Congress/Big Oil/Big Business/Military robber barons, so the desperate collection agencies and other grifters are attempting to collect unpaid debts from innocent people by terrorizing them into submission. Apparently, this criminal activity has extended into rogue "back-taxes" scams, as the rift between Wall Street and Main Street continues to grow, particularly with Europe's increasing "bail-outs" joining these ranks of career criminal low-lifes.Word of advice. NEVER answer any calls you don't recognize or are not expecting. Use selective call rejection service if available, or switch to an Internet-based telephone service which provides comprehensive call rejection options. If rogue calls become chronic, turn off all the ringers on all of your phones except one, and set its volume to the minimum setting. If you don't answer the call and the caller is legitimate, they will usually leave a voicemail after the first or second try. Rogue callers never leave voicemail messages because that could be used as evidence a***nst them if it came to a lawsuit. If you receive a rogue letter in the mail warning you of some "collection" action a***nst you, if you don't actually owe it, reply with a short letter stating that you don't owe it, you've never done any business with them of any kind, and you expect the collection agency to close the matter, stop harassing you and take any bad credit marks they've caused off of your credit rating, and furthermore, that any further contact from them must be in writing and signed on their official business correspondence letterhead. Send your letter to them a.s.a.p., always within thirty days, first class certified mail return receipt requested. If they refuse it and you get the letter back unopened, leave it unopened and save it in your files as evidence a***nst them should they pursue legal action a***nst you. If they did receive it and continue to pursue action a***nst you, let them. The judge will throw it out of court if the rogue agency's attorney(s) doesn't drop it first. Warn all your friends about this rash of desperate collection agency and other criminal acts of terrorism, and how to combat them. You have legal rights. Learn them and exercise them. Above all, keep a record of everything, of every rogue call w/ caller ID information displayed including exact time and date of each call. 4/16/10Got a call from this number in northern California at 9:30AM my time. Young woman caller asked for "Nick". ***g up politely when I told her there was no Nick here...
Received a call claiming a federal tax lien has been put a***nst me. I asked what organization she was with, she replied Berkshire Financial. I let her know that the IRS contacts people through official mail only. This is quite strange since my tax return was accepted and I receive a refund allready. Must be desperate.
Received call from this number twice today 2/10/10. Second time message was left about having to help me with state taxes.
