My husband got a telephone call from this woman this morning stating the very same everyone else, however; she identified herself as Officer Nichole Cochran badge number 6614, states that there would be a warrant issued for his arrest by noon today(eastern standard time) if he did not return her call. She went on to state that she has him on camera writing a check from an account that has been closed for over 10 years, but here is the thing.... IT WAS A CHECKLESS CHECKING ACCOUNT! The only time a "check" was issued is when he went to the bank and got a certified check from the bank. Sorry Miss Cochran.... Need to verify your facts before your calling and threating individuals and leaving very detailed messages including social security numbers and VIN#'S from automobiles. You are no threat to us, my dear. Please feel free to head on up to Ohio from Georgia and then we will have a nice discussion with our lawyer and the judge when your *** is being thrown in jail for violating every HIPPA law that your company has to follow and when we press charges a***nst you for violating Privacy Laws.
They sent a fax to my job! Even gave some case # and federal #? WTH?I called and no one answered. Their website has no contact info. Then I found this..smh! How do all these companies get away with this mess???
This lady Nicole Cocrahn called my cousin stating that if I didn't call her by 11/15/2010 she would turn my case over to the local police and that I would be arrested for a check she has me on camera writing. I is in Ga and I'm in louisiana, she has my personal info, who is ?
This lady Nichole Cochren called my parents home stating that I owe some outstanding bill from a bank, not only did she give my personal information on a VM but she called my PARENTS house. She gave out my social security number on a VM. She said that I would get arrested and charges would be filed in my state. She was from GA and could not have been anyone of the courts or police. My husband called the number back and of course she did not answer so he left her a message stating to never call a***n and we are filing a report with the district attorney's office here in MD. So NICHOLE if that is your real name ... be prepared you are going down!!!!!!!!!!!!!! Yours Truly,Angry Caller

I received the same exact phone call at approx. 1:45pm on August 10, 2010. The supposible investigator asked me for $1,167.00 By 3:00pm or she would file a lawsuit and have my County Sheriff pick me up and I would spend 2 - 5 years in prison. I refused to comply and handed the phone to my husband. She told me to expect the sheriff tomorrow. I was afraid that I would be picked up at work, how embarrassing. All for a crime that I never committed. Especially not one from 2007!
I found this tonight on aol's main page please read and let me know if you still the same way.America's new debtor prison: Jail time being given to those who oweMartha C. WhiteJul 15th 2010 at 8:00AM More Text SizeAAAFiled under: Borrowing, Credit, Debt, Bankruptcy, 101 credit&debt, In the NewsDebtors prisons were federally abolished in the United States in the 1800's, yet in certain states, they seem to be making a comeback. Out of Minnesota come disturbing reports of Americans being thrown in jail due to outstanding bills -- sometimes for as little as $85. The S*****ribune of Minneapolis profiles a number of people who say their debts got them jailed, including Joy Uhlmeyer a 57-year-old patient care advocate who was pulled over on her way home from visiting her elderly mother and put in jail for a night for missing a court hearing about unpaid debt. The S*****ribune reviewed the state's court do***ents and found that arrests like Uhlmeyer's are up 60% in Minnesota over the past four years. And Minnesota isn't the only state where this is happening. It's a turn of events Ed Mierzwinski, consumer program director at advocacy group U.S. Public Interest Research Groups (or PIRG), calls a "very bad situation for consumers." Mierzwinski attributes the practice to "bottom-feeder debt collectors [who] are very aggressive."People who are imprisoned for their debts are technically locked up for contempt of court after failing to appear for a hearing pertaining to their debt. It's a legal loophole that debt-collection companies are increasingly using. Here's how it works: First, the collections company files a lawsuit a***nst the debtor, which requires them to appear in court. If the debtor doesn't show up, the creditor wins a default judgment a***nst them. This allows them to ask the court to schedule another hearing at which the judge can go through the debtor's****ets and determine if actions such as wage garnishments or bank account seizures can take place. If the debtor doesn't show up to that hearing, the hammer of justice can come down hard and fast. From there, the judge can order the debtor in contempt of court and issue a warrant for their arrest. If this seems unnecessarily punitive, the price to get out of jail is even more so, say consumer advocates: Generally, the judge sets the cost of bail at the amount of the disputed debt, an amount which is then turned over to the creditor. "This is the private use of government resources to collect debt," Pete Barry, partner at law firm Barry & Slade LLC, told Walletpop. One of Barry's clients was arrested at her workplace for not filling out and sending back a form demanded by the creditor. The client, Barry says, suffered the humiliation of having to have her boss come to the jail and post a bond before she could be released. The bond money, he added, was turned over to the creditor. "They're using the court system as their collection agent," he says. "There are big issues," says Ira Rhinegold, executive director of the National****ociation of Consumer Advocates. "Minnesota isn't the only place it's happening, but it seems to be the worst. They're leading the way," he says, noting that NACA has heard similar stories out of Wisconsin, New Jersey, Arkansas and Washington. Rhinegold tells Walletpop that some unscrupulous debt collectors never even send debtors the required notification that the case is being taken to court. Then the debtor fails to show up and the collector wins a default judgment, which can pave the way for imprisonment until they post their bond. What's behind all of this? "In some ways it stems from the growth of the debt buying industry," says Rhinegold. Collection agencies buy debt for pennies on the dollar, then hire lawyers to chase after even the smallest amounts. Of all of the unfair aspects of this chain of events, advocates say the most galling is that, in many cases, consumers may not even be legally responsible for the debts for which they're being jailed. In fact, the debt may not even be theirs, the amount may be inflated by penalties and attorney's fees, and it's almost certainly been written off by the original creditor -- who then resold it for pennies on the dollar to a debt-collection firm that plays hardball to get money from consumers. Often, says Rhinegold, the collector doesn't even have the paperwork that would prove that existence of the debt. In these cases, the judge will dismiss the case a***nst the debtor. All the debtor had to do was show up for their day in court. For this reason, ***l Hille***nd, financial services campaign manager at nonprofit Consumers Union, says it's vitally important for consumers to respond if you get a letter threatening legal action and requiring a court appearance. The name of the collector can c****e because of how often debt is resold, she warns. So if you have an outstanding debt, don't****ume that a notice that seems to come from a different company than the original lender is junk mail. "The problem is that people don't realize what it is," she says. It's important to do some research first, though. If the debt isn't yours, you can dispute it. Even if it is, showing up to court can sometimes lead to an outcome in your favor if the collector can't prove you owe the debt. Either way, it will keep you from being hauled off in handcuffs.See full article from WalletPop: http://srph.it/d7a0jA
FDCPA, FCRA Laws are in fact Protection for the consumer from any UNFAIR collections practices. The reality of it all people, When it comes to Bouncing a Bad Check in Most states, it is a Civil matter, and you can be required to appear before a Muni****l Judge or Arbitrator.Thats a FACT, not a threat.****Can I set the record straight for most you persons on here who aren't collecotr's, don't know the collections laws, have never worked in a Payday Loan store, or ever collected on a bad check for a payday loan? Thank you. 1) If you don't pay your bills, they Will be sent to collection agencies2) Collections agencies CANT send you to jail, they cant put a warrant out for your arrest, regardless of the type of debt3)If the bad check goes to an Attorney office or Investigation firm, and the Payday loan was reported as check fraud - it gets a little more serious and tricky because these people are usually Retained by the Payday loan companies4)In most states, aside from all your other debt, (mortage, car loan, credit cards, bad debt, etc) WRITING A CHECK TO A FINANCIAL COMPANY THAT BOUNCES CAN BE CONSIDERED 'CHECK FRAUD' IF THE FUNDS ARE NEVER RECOVERED AND IT IS A CIVIL MATTER THAT "CAN" BE EASILY DEALT WITH IN YOUR LOCAL CIVIL COURT5) The consumer protection Gurus out there have all the right intentions to want to protect Americas wallets, but they should not go into battle unless they are prepared with the right information (Per State Law) not Federal law. A***n, it can be considered CHECK FRUAD in the STATES laws and go to court if not paid or recovered. FDCPA has no relevance to matters not considered under its jurisdiction.A prime example: If you break a non criminal traffic law in your city, you go to your local court. Even though you have FEDERALLY protected rights a***nst illegal and unfiar searches from the police and rights once arrested, you dont go to the Feds for a traffic Citation case (a civil matter), you go to your local courts. The same goes for Check Fraud. In certain States of the USA, [which ever state that is for you], if you bounce a check a***nst a FDIC insured account (meaning the feds own the account so they can make laws about it) it is considered a CIVIL Matter (in that state where the check was bounced). All civil matters [$$$, monetary funds, Money, Mulah, Cash, Dough) are under the jurisdiction of your local muni****l Civil court. PERIOD!****ng out your credit card is not a civil matter, going negative in your checking account is not a civil matter, not paying your car payment is not a civil matter[they just repo the car]America, do your own research, do your own homework on the laws rules and regulations that affect you. Don't let the small print in Payday Loans contracts and the Gurus of Consumer protection, blind you from know the truth.
they told me the exact same thing
A friend of mine got a call from this woman, the number originates in Georgia. A bank would not call to inform you of an overdraft they would send you mail. If it was a hot check the bank would get the county involved where you lived and you would have been summonded to court to answer for the offense and since a hot check is a misdemeaner you would spend between six months to one year in jail but most likely the judge would give you a year probation and be required to take a class on check writing. Ther most this could be is a collection agency in which case she has violated FCC federal regulations by making threats over the phone. This person is now a person of interest to the IRS since she has called a federal facility and threatened a federal employee while in the course of their duties. My advise would be to ***n as much information from this person while you have her on the phone, Name, company name, complete physical address and who they are collecting from. Call the local law enforcement and give them as much info as possible if at all possible get a web site and report it to the FBI. They have commited numerous federal violations. Don't get into a shouting match with them it's not worth the aggrivation.
Do not fall for this I just got a call as well I asked them to fax me do***ents I want proof a so call case from 2006 we are now in 2010 and they threaten me by taking me to court and so on well I'm in Texas and I know my rights as I work close to our collection Dept and the gentelmen still would not fax me my doc's nor did he offer to mail them nothing, I was told by attorney to always request do***ent's and proof and so on, Was I scared no Cause I know my rights and I refuse to pay somthing that I have no proof of.
I recieved a call from some lady by the name of Nikki Harris stating that she was a private investigator with georgia county. This was on 6-18-2010 she apparently called my sister in law and told her that if i didnt give her $3,787.45 dollars due to having a check by that day that they would have a warrant out for my arrest. Well this lady called my job and told them that i needed to contact her a.s.a.p. if not she would get a warrant. I then called this lady she had my account number and banking routing number.I asked her that i wanted a copy of her iden***y where she was from and a copy of the apparently check that i had written in 2007. She stated that she could not fax anything cause it was confidental. So she told me that i had till Monday 6-21-2010 with that amount in my checking account or else she would get a warrant for my arrest and i would have to serve 12 months at a correctional ins***ution. I have tried calling her at this number 404-935-9487 and she will not answer.
My sister got the same call from a lady who claimed that I had check fraud also. she said that she would issue a warrant for my arrest tonight if I did not call her back. I have not had a checkings account in over 5 years and do not know where this is coming from. I have tried to call her back several times and can't get her to answer me and do not understand what is happening. After reading the post from Jackie, I have this feeling I am getting *****ed by someone who is trying to get my money. Does anyone know how I can find out if this is legit?
got a voice mail from a lady who claimed to be a check fraud investigator for the county i live in, even though she is calling from more than 2000 miles away, she told me if i did not give her company 1,050 dollars there would be a warrant issued for my arrest. she had all my personal info and my cell phone is on a family members account so how anyone can find me by looking up my number is odd. i did have a conversation with her she was rude and threatening and said if i dont pay the money by credit card by 2pm i would go to prison for 2 to 5 years.
