Leave a CommentA third party bill collector (not the creditor, but an agent of the outside collection agency they hire) is only allowed to call third parties such as a debtors neighbors, friends, relatives and a former employers, once. Any additional calls are violations which the collector can be held personally liable for in civil court, I think it's $500.00 per infraction. Do***ent the calls, file a police report and sue the agency, the collector and their creditor in small claims court. A collection agency that gets their client sued usually loses the client, even if it's in small claims court. Further, if you don't sue the creditor, chances are you'll get call from the creditor's secondary and terciary collection agencys (they usually hire 3). You see collection agencies have a nasty habit of closing "hot" accounts and returning them to a creditor without disclosing that they should be written off. The creditor then unknowingly sends the account to thier secondary agency and your nightmare s****s all over a***n.

I received a call to my cell phone from this number. The man identified himself, asked if I knew so-and-so (my brother) and did I ever talk to him, etc. - the usual collection agency type b.s. I told the man yes, I knew him, no didn't talk to him often but could e-mail him. Sent my brother a nasty e-mail and looked up the toll-free number the man gave me - came up as AmeriCredit (1-800-944-5047). Man am I ever sick of deadbeat relatives using me as a reference. :(
