At one time I worked at a debit collecto. First off the person that calls you gives you a fake name. FDCPA has alot of laws the protects the debitor. Please make sure to find those laws that pertain to your State. Read them and prepare yourself so the next call your able to stand your ground instead of being caught off guard and not knowing the laws that are there to protect you.

What is the deal with these people? Are they legit or not. All i read about them are complaints. Not sure what they are trying to "collect" from me but whatever it is, will it mess up my credit? Do I pay them for what they are asking??? PLEASE ADVISE.

Someone called my ***her who lives in another state and s****ed asking him alot of questions and coerced him into giving them my phone #. They already had it. They would not tell him who they were with. This is egregious!!

Called both my ***her (on his cell phone) and me about my brother and his wife. Told don't have any contact info except an address so not to bother calling a***n. How they got my number is a mystery as I don't even have the same last name as my brother! Or even live in the same state.

Received a call today - they left a message to call 866-284-4374.To Responsible: Some of us have been hit by the recession, medical bills, serious illness etc. and are legally (albeit reluctantly) having to file  bankruptcy. They cannot legally sue me because I live in FL and they are only a part of the Texas State Bar****oc. Capital One IS the hardest creditor to settle with. They would not lower my interest, they would not take interest out, they could not let me make small payments (as much as I CAN possibly make right now). They said even if I did, it would not stop the process because I am not paying THEIR limit that they require from me. SO, instead of paying them SO****ING, I will pay them nothing. No point in giving my money away only to see my credit isn't getting better and the voultures are still hovering over head.They can sue me, but my net worth is sooo negative, so I don't see what they THINK they're going to get from me. Little do they know, I am now pregnant so.. GOOD luck to them. If they think my funds are slim now, just wait another 4 months.

I'm finding Capital One to be the most difficult creditor to deal with.  They're "settlements" aren't feasible for someone who's having financial problems.  James West representative called me at home and on my cell.  The caller's message was rude and threatening.  I have no intention of returning their calls.

I reached a settlement with American Recovery System, never got a settlement letter or any type of paperwork. They just disappeared. Then  get a call from this Attorney James West which I found out is a collection agency. Asking me to call a 1800 number instead of their office number that appeared on my cell phone. They should be in jail, the thing is you can't trust a collection agency. I have this one guy calling from a different company every other month, first he was from chase, then american recovery systems and I'm sure he is with Jame West now.

I received a voicemail from a woman named Kyra stating that she was calling from Attorney James West's office and gave me an 800 number to return her call. Not knowing this lawyer, I tried multiple reverse 800 directory look-up services and found NO LISTING. Upon further internet investigating I found multiple complaints regarding this company's tactics and decided to post this note rather than return their call!

This person called me and was very rude. He then called my home phone a***n, and threatened my 16 year old son with "I know where you live and I'll just come over and get you." He was very beligerent toward me the day prior at which point he threatened me. If this number appears on your caller id, do not answer it. These low life ********* don't deserve to live.

they sent a letter and i riecived it about a week an half later after the date on the letter then they called my mothers phone then called me on my phone while i was at work then i called them back after they called on 4/2/09 and they wont even settle or take a payment of what i said i would send them and they told me over the phone that they will tell the credit card company that i am refusing to pay which i told that guy im not refussing you are refussing to take a payment aqnd told me to get a lawyer in a rude way and the call only lasted 3 minutes

I am another victim. I say all that have posted need to file complaints with the Federal Trade Commission. So that they can get sued once a***n for illegal debt collection actions. My credit card debit that was turned over is only $2,000 and they act like I owe a million. More than that I had already set up automatic deductions with the credit card company. I could go on and on but I will spare you.

I'm receiveing Phone Calls on my work celphone number and they leave messages on my office phone. John Reyes is calling and states that she is calling for me and then leaves a the message. that “That this is an attempt to collect on an outstanding debt and to call the office immediately or legal action will be taken. I live in Florida and from what I have found is this James West is not licensed to practice law in Florida. Also from my understanding they are not allowed to discuss or mention anything referring to my financial situation. This person is calling and leaving these messages on my cell phone which has a generic outgoing message that just states the phone number you are calling. She has no idea of who is able to hear these messages. Clearly in violation of FDCPA. Thank you,

I had a call from this company looking for someone I do not know. My mother is in the hospital with congestive heart failure and I really need my telephone line open in case so****ing happens to her so I can get to the hospital immediately,but this company keeps calling asking for someone I do not know and I do not know why they are doing this at all to me or my family.

I finally answered the call from James West after 10 calls over the last month. He asked for a person I don't know and have never heard of. I told him so, and asked him to quit calling. A law suit being filed a***nst a family member (gave a name) I did not confirm that I knew or did not know the individual. I was than told that a complaint will be filed a***nst me for with holding information. I was also told the called was a detective.

I just found this guy's website - he must be a good old boy from Texas.  He has these hideous cartoon characters all over it, what kind of person would want to hire his office.   He also had some old crow call my cell last Sa****ay morning at 8:15AM, she sounded like she could be laying down waiting to die!  I just found a letter in the mail box from him too, he has Capital One as a client.   I will write this guy a letter and see what it takes to get him to back off.   They are all a bunch of vultures, need to take a look around and see that it so****ing they have to work on with the people and be realistic.   Let's face it very few people have any money to spare.
