SAME NUMBER, SAME COMPLAINTS FOR OVER A YEAR?ON DNC LIST, BUT NO HELP?IS ANYONE LISTENING HERE?
Somehow this 7609303472 number has my cell phone number. I don't answer it anymore, but what a pain. It's good that I don't use voicemail or I'd go broke. And with the cell phone, you can do nothing, except pay for blocking the number. Well, guess I'll just have to let everyone I know about this site and the number, and if it's connected with Broderbund or w***ver, $90K is just peanuts to them. They just want more sales. I'll be looking a lot closer at the software I buy also - just who really makes it. GRRRRRRRRRRR!!
I had a few ****-ups from this number after picking up. I also bought Reader Rabbit Workbooks from the Learning Company, which automatically signs you up for this SPAM (you have to log back into your profile and check that you DO NOT want to receive their marketing phone calls -- it's not automatic). Anyways, the last time they called in April, I answered and told them they had the wrong number. Haven't gotten a call since.
Time they claimed to be from Microstar Software. New number and location. There was a lot of creative swearing on their end.
They called me yes****ay and I didn't make it to the phone. They called a***n today. He said they had gotten my number when I bought some children's Reader Rabbit workbooks from the Learning Company. He said I had marked in my profile that I would be interested in discounts on computer items and that was why they were calling. He asked if it was OK. And I said no I was not interested and I had probably****umed in marking that it would be done through emails not on the phone.
got a call from 7609303472. did not get to the phone in time to take call. it only rang about 4 times
They call me 3 or 4 times aweek, to date I haven't answered. It is very irritaing. A co-worker told me about this website as she also receives similar calls. Thank goodness for sites like this.
This number is cross-referenced with 1-866-297-2530. Both seem to be the same annoyance calls. Watch for both. I am in Ca***a, tracing the calls and attempting to prosecute through our phone company.
Release Date: May 23, 2002California Software Marketer to Pay $90,000 For Not Disclosing Terms of its Continuity Software ClubCompany Allegedly Made a "No-Risk" Trial Offer and Did Not Tell Consumers about Continuous Shipments and a Non-Refundable Membership FeeThe Federal Trade Commission announced today that it has reached a settlement with Micro Star Software, Inc., a Carlsbad, California, software marketing company, and its president, Stephen Benedict, resolving allegations that they misled consumers by misrepresenting a 30-day trial offer for software as "no risk." In fact, consumers had to cancel during the 30-day trial period to avoid a membership in the Crystal Vision Software Services club, and to avoid a $49.95 non-refundable membership fee, and continuous, additional monthly shipments. Under the terms of the consent decree filed yes****ay on the FTC's behalf by the Department of Justice (DOJ), the defendants must pay a $90,000 civil penalty, disclose all material terms and conditions of trial offers and continuity program memberships, and monitor the behavior of their telemarketing representatives. The FTC alleged that the company violated the FTC Act, the Telemarketing Sales Rule (TSR), and the Unordered Merchandise Statute.According to the Commission's complaint, the defendants used telemarketers to pitch a supposedly "no-risk" 30-day review period for its computer software packages for $19.95. The telemarketers obtained consumers' credit card account numbers to charge this initial $19.95, and told consumers that they could get a refund of the $19.95 by calling the company within the 30-day trial period. But the defendants allegedly failed to tell consumers clearly and con****uously that if they did not call to cancel within the 30-day trial period, they would automatically be charged a non-refundable $49.95 membership fee and become members of a software continuity club that ships additional packages of software each month for $19.95. The telemarketers also did not disclose that these charges would appear automatically on the credit cards consumers had given to pay the initial $19.95, according to the FTC.Terms of the Consent DecreeUnder the terms of the consent decree, Micro Star will pay a $90,000 civil penalty for its alleged violations of the TSR and will be prohibited from violating the FTC Act, TSR, and the Unordered Merchandise Statute in the future. Specifically, the decree requires Micro Star to disclose clearly and con****uously during initial telemarketing calls all material terms and conditions of any trial offer that leads consumers to incur financial obligations for additional products or services and the terms and conditions of any continuity program membership. Micro Star must make these disclosures and obtain consumers' consent before any additional shipments are made. Micro Star also will be prohibited from violating the Commission's Rule on the Use of Pre-notification Negative Option Plans. This Rule requires companies to make certain disclosures in advertising if they operate a pre-notification negative option club - i.e., a club that notifies members in writing before it ships any merchandise, giving consumers the opportunity to reject the merchandise before it is shipped. Finally, to ensure that consumers receive the disclosures required by the order, the consent decree requires that all product packaging repeat the material terms of the program. It also contains standard record-keeping provisions and requires Micro Star to monitor the compliance of its sales personnel, keep track of consumer complaints, and take corrective action in response to behavior that does not comply with the order. The Commission vote to accept the complaint and proposed consent decree and forward it to the DOJ for filing was 5-0. They were filed in the U.S. District Court for the Southern District of California on May 22, 2002NOTE: This consent decree is for settlement purposes only and does not cons***ute an admission by the defendant of a law violation. Consent decrees have the force of law when signed by the judge.Copies of the Commission's complaint and consent decree are available from the FTC's Web site at http://www.ftc.gov and also from the FTC's Consumer Response Center, Room 130, 600 Pennsylvania Avenue, N.W., Washington, D.C. 20580. No one was there when I answered, but they didn't **** up
Repeated calls, off and on, for the past month or two. No one is there when I answer the phone.
I just received a call from this number and when my boyfriend answered, a man on the other line asked for me. When I answered the phone, all I heard was breathing. They ***g up.I am not sure who to contact about this but if this is coming from a company, I am going to personally report you to the Better Business Bureau or whatever its called in the United States.I do NOT appreciate phone calls like this.
cross posting information I have found. I have followed up on the information below and found it to be accurateThis company represents Broderbund software, i.e., Print Shop, etc. If you registered on-line, they are calling because you checked off that you were interested in hearing about discounts on items for your computer. All you have to do is say, "I do not remember checking that option off and no thank you or that you are not intersted." They will nicely end the call. It's no big deal. Answer the call and just tell them you are not interested. At least all of you who posted on here know that they are connected somehow to Broderbund software - Print Shop and Print Master software.Microstar Software / Crystal Vi******0-777-4228www.microstar-usa.comCaller Type: Telemarketer
