The company name is National Advertising, they dont tell you that they're a debt collector, only the said: we have a very important message for you and we received your file". According to the FTC (federa trade commission) all the companies have to indicates who they are and if they are trying to collect a debt. Also the call very early in the morning, very late on the night, weekends and I dont who the call my mother-in-law. The # thats appears when they call is
Dear Drew, Would you consider testifying as to the behavior and collection tactics that this company uses? I am trying to get my state rep to sponsor a bill for reform for the collection laws and to put a stop to abusive collectors such as NES. I admire the fact that you have a conscience and quit your job with these losers. My personal goal is to have this company shut down for good, and to have the collectors themselves put in jail for breaking the law. I really hope that you will consider testifying.
Called this morning. Threatened to send whatever file he has to the county in which I live. Did not leave a company name just so****ing Howard. Maybe Ron or Bryan like above said. I dont even know who this is.
They called me tonight and threatened me with litigation so I told him to go ahead as his condenscending demeanor smelled of bs. I tried to reason with him and explain how it would be ridiculous to take me to court when I was willing to make payments,just not the ridiculous amount that he was requesting, yet to him it was worth it I suppose. Either that or he just knew that the call was a fail. Do they really think we are this ******?
I received a call from "unknown number" and a woman left this message. I have an urgent call for ****** from NES. please call Irene Clark at 1-800-236-2380. I thought it was an emergency message or so****ing until I read your comments. They should all go to jail. I'm going to call her and record the conversation and send it to the Today Show.
I have dealt with collectors every now and then, most have been very "human".NES has been the worst ever! NES has been calling my work place 4 times a day, I can only go to the phone if it's an emergency...no personal calls. My boss has even confronted me about this and is getting mad at me for their actions.They have called my wife and told her I had a court date...not. She freaked out on me about that. They make it sound like they are calling from "the office of" NES only to make it sound like they are a legal firm. They are rude beyond belief, even the message on the phone is "CALL US IMMEDIATELY!!" or else "I will have to recommend legal action a***nst you". They won't even say why they are calling. I'm just the average Joe trying to get my marriage and life back together and yes there have been some past due bills to catch up on. BUT NO ONE SHOULD DESERVE THE TREATMENT THEY DEMONSTRATE.
We got a call from this company tonight, and the woman told us that there were two options, both requiring ridiculous amounts of money to be paid in extremely unreasonable amounts of time. Quite simply, it was just one threat after another. I told her that I needed to discuss these "options" with my husband and that I would call her back in the morning, and she said that she'd need to hear back first thing, and that I could make the payments by credit card or check by phone.What's more, when I told her that we could not make such large payments on such short notice, she said that "where there's a will there's a way" and that we should borrow money from family members or take out a loan. Seriously? I'm headed to our attorney's office tomorrow.
I received a message on my cell phone(the ID said unknown)and on my home phone. The 1st on was nasty and threatening me with a lawsuit or jail if I did not call her back(x1016). No name. She also called my home phone as well. I am disabled for 2 1/2 years and do not receive any money or health insurance. We live from paycheck to paycheck and my daughter invites us over for dinner. I do get food stamps but it is not enough but it helps. My daughter got them to admit it was from sears and they(the collection co, National Enterprise Systems) would slap a lawsuit on me and I would owe 3 times more. I am not able to work, this note has taken all most 2 hrs to write.Did anyone get the law suit or have someone show at there door?
UPDATE:I did file a complaint with the Better Business Bureau, and that seems to heave worked, as National Enterprises has not called me back.:)
Received call today from NES and****ociates, representative Kathy DeFranco. (At work) She says that I or my attorney need to contact her at 1-800-236-2380 ext 1159 by noon regarding a complaint that would be sent out through my County Muni****l. She then gave the complaint file number. Didn't say on behalf of who or what this meant. After reading this site I am not sure weather to call her back or not or to wait and see what happens.
I received a call yes****ay at my place of employment so naturally I didn't pay much attention to how was calling. All I can remember is that he was from National Enterprise Systems. This very ignorant individual went on to tell me that the company that he was representing was going to garnish my wages if I didn't pay up the $900 so****ing dollar immediately and would I be writing a check or paying by credit card. I told him that by neither. He continued to say that it was because of people like myself that the economy was in the situation it was in. Then he continued to tell me that they would probably have to call INS on me so they can revoke my Green Card and have me deported. Has he done his homework I am a United States Citizen of Puerto Rican decent which doesn't require a Green Card. I have never been so upset in my life. So obviously I lost it and cursed like a TRUCK DRIVER and ***g up. He proceeded to call my job back a***n to get the last word in and say pay up you Alien. Even if I had the money to pay this debt I would never ever deal with a company who has employees calling individuals and treating them like this. I too will be submitting my complaint to the better business bureau. Then today I get a call from a Michael Edwards on my answering ma****e at work not stating his company name saying that his co-workers have informed him that I have been ducking their calls and that I needed to call him immediately today before 5 PM at 1-800-236-2380 extension 1896. Obviously I will not be making that call.
I got a call from who I will call "Mr. Rude"!!!!! He yelled and screamed etc.. I want you to know when he was told the person he was calling for was not available, that I****umed they already left for the store, he said I was lieing because he hadn't seen anyone leave the house. Not only did he say he was wat****g the house but he was going to send someone to my front door to verify if the person he was asking for was home. "NO one came while I was there. Real yelling and screaming ****! I am not only going to call the Better Business Bureau and my Attorney but I will be filing a complaint with my local police department and reporting them as a stalker since he said he was wat****g us.
First of all, you made him mad because legally, he CAN'T tell you what the call's about. That would be a violation of the Fair Debt Collections Practices Act. And we ALL know how much they hate to violate THAT, right?! :)What you can do is mail them a Cease and Desist letter. Do NOT put your BFs name ... do NOT mention him whatsoever. Just give YOUR phone number (since they already have that, anyway), and tell them that they are no longer to contact you. At ALL.Another thing you can do is politely let them know that further calls from them to you will be taped. Let them know that you WILL be keeping a voice recorder next to your phone just for such occasions.Also let them know that any further harassment will result in an official complaint being filed with the Better Biz Bureau AND your state's Attorney General's Office. And go ahead and toss the Federal Trade Commission in there, just for kicks! ;)
So sorry for the debt collectors, but even if they DID get a judgment from you, SSI, and Disability are protected from garnishment. They can't freeze'em.Chances are, they won't call back. Do you know how old this debt is? If it's run out of the statute of limitations, tell them to go pound sand. Better yet, send them a letter notifying them that the debt is out of SoL and to cease and desist contacting you. Period.Best of luck to you!!
A Miss Clark called me from this number, had me in tears as she threatened to freeze my SSI checks if I didn't give her $900.00 IMMEDIATELY. She then got my 72 year old Mother on the phone and threatened her. She was asked to call us back in 5 minutes. During that 5 minutes, I called my attorney, who was out the office said to tell her that on my attorneys advise they would have to wait for tomorrow for anything to happen. She agreed to this (suddenly very pleasant)and I will discuss this with my attorney in the morning. We will wait and see if she calls me back!
I was staying at my boyfriend's house when I got a call from this number while he was at work. The man addressed himself as "Dewain *****" and gave an extenstion of 1260. He said to let him know that he MUST contact him before four o' clock today. He seemed so urgent and acted as though my boyfriend knew he was supposed to contact him. It all seemed pretty fishy to me.
Just got a call at 8:30 this morning from National Enterprise Systems. They were looking for my boyfriend, not me. I told them he was not home, and they immediately asked if this was a legitimate contact number for him *** ... if THEY were legit, they would already know this, wouldn't they??) When I told the "gentlemen" on the line that I would like his name first, he gave it to me ... Ken Wills at (x1364). However, when I asked him what the call was about, he would only say that he needed to speak to my boyfriend and demanded that I confirm that this was a legitimate number to reach him. (I did not confirm this, I merely stated that I would be happy to pass the message on to him as soon as they told me what the call was about."Mr. Wills got progressively ruder as the call went on, and kept demanding (more and more aggressively) to know if my number was a legitimate contact number. He refused to tell me anything about the nature of the call. Finally (now talking over his very loud demands to confirm that my number was a contact number), I told him that I would pass the message on, but please do not ever call my house a***n this early in the morning.His response? "IT'S NOT EARLY!!!" and ***g up.I called back and got Mr. Wills on the phone a***n. Asked to speak to his supervisor. He got someone on the phone (no idea if it was really a supervisor or not, though he said he was when I asked), and advised him to speak to Mr. Wills about his rude behavior. I went on to repeat that I had told Mr. Wills that I would pass his message on, but not to call me a***n so early, because it was 8:30 on a Sat. morning and they just woke the whole house up. I tried to explain that my daughter and I had just been diagnosed with severe bronchitis and had spent the last two days shuttling back and forth to the Emergency Room, but at that point, the supervisor got very agitated and s****ed to yell at me. He basically said, "WELL MR._______ IS IN SERIOUS TROUBLE, SO YOU BETTER HAVE HIM CALL US BACK. WE'RE NOT TRYING TO HARASS HIM, WE'RE TRYING TO HELP HIM AND HE'S IN *REAL SERIOUS TROUBLE* SO YOU BETTER MAKE SURE HE GETS THIS MESSAGE." ... and then he ***g up on me.I'm lodging a complaint with the Better Business Bureau, but in the meantime, does anyone have any advice for me?? I'm sure that they're going to s**** calling my house more regularly now. I recently worked at this horrible place. National Enterprise Systems is the collection agency from*****. It's the devil's worst nightmare. Employees are trained to collect according to the Fair Debt Collections Practices Act but once on the floor in their respective departments collectors are told to forget everything they learned. My supervisor, Bryan Howard under the alias of Paul Stevens, regularly provided a second voice to collectors having trouble closing collections. This idiot would identify himself to callers as a federal agent, an NES attorney, etc., anything to try to scare the debtor into paying. He would actually tell debtors and their spouses that a lawsuit had been filed and if the account is not paid by postdated check by a certain time that day a deputy of the court was coming to serve the debtor on his job. I witness this on a daily basis all day long. B. Howard is neither a federal agent, attorney nor any of the other things he claims to be and NES don't sue debtors. All are clear violations of the Fair Debt Collections Practices Act. Debtors are talked to as if they're inhuman. Even when the debtor is not home the person taking the message is treated like dirt. I will never forgot my supervisor shouting at an 81 year old African-American woman for not getting a pen and paper to take the message. "I DON'T CARE IF YOU ARE 81 YEARS OLD HE SCREAMED AT THE WOMAN." I've witness collectors hollering at kids "GO GET YOUR ***HER."You are not supposed to talk to spouses—in certain states--about their significant others’ debt unless given permission by the spouse to do so. This rule is ignored at NES. In fact when I left training I put the do***ent about the spouse rule on my cubicle wall to reference only to have it ******ed and trashed by Bryan Howard who said I wouldn’t need it. The owners Ernest Pollack, his wife, and two sons: Scott and pie-faced Chris are well aware of what is going on. These people are hands on owners. They constantly walk the call room floors, note the individual collectors and group collection sales and hear all the violations first hand. The more a collector screams at a debtor the more they like it. People actually clap and cheer when a collector goes off on a debtor. All that concerns these greedy money grabbers is how much money they are collecting at any given time.Payments are demanded in full although they do offer settlements that are too demanded in full. Money orders and mail-in payments are not accepted, only postdated checks over-the-phone or Western Union Transfers for Citi Bank accounts. Some other creditors do allow NES to also take payment by credit card. For the postdated checks debtors are asked to give their accounting and routing numbers. NES, the s***bags they are, attempts to take the money out before the postdate. Nice company huh! Collectors and supervisors once provided with bank info by the debtor call banks automated customer service numbers to obtain how much money they have in their accounts. We have their social security numbers so getting info this way is like taking candy from a baby. Some banks have safeguards a***nst this and required you talk to a live person. They also work this wickedness on debtors’ credit card accounts or the credit card accounts of the debtors’ spouse, mother, ***her, etc. I remember one collector on the phone with a debtor saying “Your Mother Has $7,000 On Her Card She Can Use;” She Can Pay This Debt For You!”If anyone needs someone who's "been there" in any of their legal actions a***nst this de****able company I’m your guy.
This company has been calling my house all week trying to talk to my son. Today a very rude man threatened to go to my sons work and hand him a summons for a lawsuit. He was yelling at me and would not tell me what it was about. I told him he could not talk to me that way. I ***g up, he has been calling every few minutes all day. My son has talked to him, but he is just rude. The company name is not on anything that my son oues either.
800-236-2380, is a collection agency.They are on the "rip off report", under abusive collection agency.
A woman who called herself Georgia said it was imperative that I return her call at extension 1440. She addressed me by first name and didn't state a reason for a return call being 'imperative'.
