This is just an underhanded and illegal trick that the collection agency is pulling to scare you into paying.They tell me that they're calling from my city's "process server division". I called my local and state authorities to confirm this and there is NO SUCH THING. As it turns out, my locality hires out process servers on a contract basis.If they really were a process server or a LEO (an official representative of the courts), they would have access to my DMV records (my home address), my tax records (my place of work), etc. Bottom line is that they would just come get me because they can. These guys are just a bunch of ***s trying to fake you out.866-969-7222The company is called Prime West Management. They deny that they make outgoing calls, they claim to be connected with "process servers".
Debt collector - low-class, no-name variety. Threaten to serve papers. One person said they did ... but it was apparently on a really fresh debt. If theywant to take you to court then let them - they probably won't even show up,and if they do they probably won't be able to prove you owe anything.Bring a lawyer to make sure the right magic words are spoken. If it's iden***y theft then you'll definitely want a lawyer ... if for nothingelse to delay the proceedings until some investigation can be done.Many ID thieves only have partial info ... a phone number & name oran address ... but banks don't seem to check - I'd call that professionalmalpractice and frankly you oughtta be able to sue them for it, justlike you can sue a doctor who does shoddy work. Remember the statute of limitations ... which is fairly short in many states. They can't collect old debts unless you do so****ing to "refresh" the case likeoffering partial payment (Clue, they'll immediately sue you for all the rest and more after your "sweet deal"). In any event, they must provide ample do***entation that you incurred the debt and it's still within the legal timeframe to collect. Very often they can't do that, they are just hoping you won't contest the case. On the plus side, a number of states are sick of these people and have or areputting through legislation to tighten the *****s on them. Whether they also allocate the FUNDING for the *****-tightening procedures is another issue ...
