Leave a CommentFederal Fair Debt Collection Practices Act (FDCPA) The most common complaint to the Federal Trade Commission (by far) year after year is complaints about debt collectors and/or collection agencies. In April of 2006 the FTC reported that it received 66,627 complaints a***nst third-party debt collectors in 2005. This was more than any other industry and nearly six times the amount in 1999. It is also important to note that these collection agencies recovered over 39 billion dollars in 2005. Unfortunately most consumers do not know their rights regarding these collectors and simply put up with unacceptable conduct.Common Violations:• Constantly calling you at work when you have asked/told them not to.• Revealing your debt to third parties.• Leaving messages and not revealing they are a debt collector.• Threatening a lawsuit when they do not intend on bringing one.• Claiming that you can or will be arrested if you do not pay the debt.• Claiming that a judgment will occur immediately if you do not pay.• Claiming that they can garnish your wages if you do not pay.• Claiming that they will put a lien on your house if you do not pay.If you believe that you have experienced one more of these violations here are some immediate steps to take prior to contacting our office.Write out a detailed summary of all violations including the date of the calls, the collection agency, the name of the person calling and the phone numbers they called from.Save copies of all letters and notices from collection agencies.Save all phone messages and voice mails.Make note of your conversations with these bill collectors . What kind of damages am I en***led to?The FDCPA allows you to collect (if successful):$1,000 of Statutory Damages .Actual damages (you lose your job, or sustain some physical or mental injuries as a result of the unlawful collection practices) .Attorneys fees and Costs . The Texas Debt Collection Act (TDCA)The Texas Act essentially mirrors the Federal Act but actually en***les you to more remedies. Unlike the Federal Act, the Texas act applies to both 3rd party debt collectors (like collection agencies) and the original creditors attempting to collect their own debt. A violation of the Texas Debt Collection Act is also a violation of the Texas Deceptive Trade Practices Act which provides for triple damages in certain cir***stances.HOW TO HANDLE DEBT COLLECTORSIf you get a call or letter from a collection agency about a debt you don'tthink you owe, here's what to do:Tell the agency in writing that you don't owe the debt and ask for proof.Write within 30 days and send your letter by certified mail with a returnreceipt requested.Don't provide personal financial information, such as your SocialSecurity number, to debt collectors.Don't pay any part of the debt — that can res**** the statute oflimitations on debt more than four to six years old. Plus, a court couldinterpret your payment as your admission that the debt is valid. If the debt is really old, be skeptical. This kind of "Zombie" debt, which may have passed through several agencies but refuses to die, could beso****ing that you in fact did pay long ago.Don't let the agency harass you. If you send a letter telling it to stopcalling or writing, it must do so, except to tell you that it is no longertrying to collect or that it's pursuing a legal remedy.Contact Weston &****ociates, PLLC if the agency stillpresses to collect a debt it can't prove you owe.It is important to note that just because a debt collector possibly violates a consumer statute, the debt that you owe is not forgiven simply by bringing a lawsuit a***nst them. (However, it is possible to have the debt waived by the creditor during settlement discussions).Even if you have decided to file Bankruptcy, and you qualify, it is possible to retain a cause of action to pursue a***nst a debt collector after your debts have been discharged.Once you have retained our office, or another licensed attorney to pursue these predatory debt collectors, they are no longer allowed to contact you personally. If you believe that you have been victimized, do not hesitate, the statute of limitations for bringing a cause of action under the FDCPA is (One year) from the date of the violation. If you believe that you have been victimized by a debt collector please call us at 713-623-4242 or e-mail at mail@westonlegallinksnotallowed.

I received a call from a collector at this company. While I was not the correct party, I thought he was very professional. He asked several questions that he said would prove I wasn't the correct person. I answered them and he thanked me for my time. I pay my bills, the rest of you should to!
David Richards keeps calling and harrasing us about a phone bill with AT&T Advertising Soultions that has nothing to do with us. We asked to speak to his supervisor and he would not give us his name. He was extrememly rude and unprofessional. We asked that he not call back to our house and he said that he was going to continue to call us. He asked very personal questions that was none of his business. He has even called a neighbor on our street that had a publically listed phone and asked him to come to our house and tell us to call him because it was very important. We have contacted the FCC to file a complaint and we are going to contact the Texas Attorney Generals office as well because we read this in a prior post. If anyone has any other way to stop these harassing calls, please post on here. Thanks.
I have gotten a few phone messages from "Mike Thomas at RCI" He sounds quite friendly, saying, "Hey I've heard that you had some sort of issue or concern with one of my Agents, and I would love to talk with you about that." Isn't it illegal to entrap someone into returning a call under false pretense?I do, indeed, have an overdue bill with YellowPages. I do not intend to pay it, and YP knows why. I am sure that's why RCI is calling me.I suspect that as soon as any person identifies him or herself (returning the call to resolve the so-called concern about another Agent), they HAVE you, and can s**** on the collections harrassment.
This guy called my grand***her, asking for me (his grandaughter) and his son. He gave a reference number and asked us to call back. We called back and he said he is the collection agent for the AT&T. Figures that AT&T would have a slime ball collection agent. And why he is calling personal residences, I have no idea.
They make all kinds of "demands" and give you "instructions". I think they work off a script, best to ignore their calls, just **** up when they call. They call back over and over, which is illegal!!
Thanks for the info, I did file a complaint with the AG office in Texas. Amy is the one who is harrassing me too, calling early and often. Very rude!!
This company s****ed calling my employer several weeks ago about a bogus bill that I do not owe. They also violated my rights by telling my boss and my co-workers about this bill. They then s****ed calling all the residents and businesses around my employers office telling them my name and that I wasnt paying my bills. I have filed complaints a***nst them with the Federal Trade Commission, Better Business Bureau, and the Attorney General's Office. They also sent a bill to my employers address which they had no right to do. I have contacted an attorney and plan to sue them! I guarantee when this is all said in done they are going to be paying me!! If you have any problems out of this company go the Federal Trade Commission Website and file a complaint a***nst them. They are going to continue operating like this unless we stop them!
who is this?
Got a call at 9:30a.m. waking me up (had been up late). Couldn't see the caller I.D. well and thought it said my parents name who are elder and not in good health so I answered it. The caller "***le" said she had been trying to reach my neighbor Mike but his line was disconnected. She wanted to know if I could put a message on his door for her. I said I would but was concerned when she gave me an 800#, Ext. #, and file #. I asked how she knew him. She said he used to have a certain kind of business and she knew him from that. I called the 800 # back and someone answered "RCI". I asked to speak to a manager. Couldn't understand the name given, it sounded sort of Hispanic and asked a***n. He simply said, "David". I told him about ***le calling and wanted to know what kind of company gets random numbers off the internet and calls them. He said they were an, "attorney referral service." I asked what that was and he wouldn't explain. I asked if it was a collection agency, but he wouldn't say. I asked what RCI stood far and he wouldn't say. I kept asking until he ***g up. I had told him if he ***g up on me, I would call a***n so I did. He still wouldn't say what RCI stood for and told me if I called him a***n he would slap me with an harrassment suit--nice guy. I called back and asked for ***le. She said she was on another line and told me to hold but I ***g up. My daughter already was on the interne looking it up. Sounds like they have a lot of fans besides me. I'm going to contact the state, but doubt they will do anything about it. They shouldn't be able to sleep at night.
This guy is a creep. Do not return his call. He is the s*** of the earth.
Received call asking for my husband (we own our business). After politely telling the caller that he was not here and could I take a message, the response was... "don't worry about it!"

(RCI) they are a debt collectors company, and they want stop teargassing us! We know about the debt and we are taking care of it with the original company and they just want stop. Ive been receiving phone calls from Recovery Concepts Inc 1925 E. Beltline Road #510Carrollton, Texas 75006Agent: DAVID RICHARDS800 931 968972 478 7858#43249last call I recorded was today 3/16/10 around 3:30pm...First time this individual named "David Richards" called he caught me by surprise..Simply because of how casually unprofessinal he was. When I answered te phone and said*****o he said "Tatiana?" I was curious and said*****o a***n and he kept going acting like he's known me, so I was confused... he said " hey this is David Richards. How are you Tatiana?" so I just answered and he kept going and told me he was calling because he had information from AT&T Yellw Pages and that he was calling to collect the money. Which is fine because he is only trying to do his job with the information he was given. When I explained to him what happened with AT&T and how I felt that there was so****ing weird going on, because AT&T NEVER sent me a bill... so how is it that they're sending a collection agency to collect from me/parents company? (but that is a different story) After he heard me out, he said " how is that my customers fault??" I was a***n surprised by his questioning me (i felt like he was tryng to belittle me at that point and like he was trying to play a role of good cop/bad cop) still I felt that was (maybe) a normal question and gave him the benefit of the doubt and answered that I felt that I didnt get to use the services the company and I had agreed upon and that to top it off they had NEVER billed me anything in over a year... BUT he answered " that's not my issue. Not my clients fault that happened. And its your responsibility to pay up. You wouldnt buy a car at the dealership and not Pay your car note because you cant put gas in it! you really need to pay up because that was your irresponsibility" What??? how does this man DARE to talk to me like that??? Especially after I politely answered to his rudeness??? at this point I was heated up!!! so I s****ed to cuss him out (which I regret a bIt because I hope that doesnt go a***nst me when I try to officially file a claim) I even told him to shut up while I looked for my supporting do***ents (which I didnt find) and he kept talking!!! saying things such as "I will continue talking to you and I guess you're going to have to listen to me because I havent been cussing at you" He got me so mad I was shaking I gave the phone to my sister but he insisted and demanded my sister gave back the phone. The call didnt end up so bad because I told him I understood it was just his job but that he needed to use ethics... I also told him I was going to call him back after I talked to a lawyer. But a few days later he called in the morning and he answered the phone the same way, escept this time it was my mother who doesnt speak english , so guess what "David Richards" speaks to my mother in spanish instead and makes it seem as if he KNOWS me (once a***n!!!) but since I was sleeping and hadnt spoken to the lawyer I told her to tell hime I wasnt picking u the phone. I'm not sure how many times he's called since 02/07/10 (the first time I spoke to him) but I know Ive seen missed calls on my caller ID... NOW today I was home busy taking care of my niece or doing so****ing very occupying with house work, when I hear the phone ringing but I let it go to voicemail... it's my little friend "David Richards" and the message he left was very similar to the first post on here!!! UGH!!! How annoying!I've been seeking some help with this and legal advise... but if anybody has any more information or advise please let me know because this treatment and lack of ethics is incredible! my email is [email protected].
Check out my post that I just added a few minutes ago.Good luck!

This company RCI Rci (Recovery Concepts Inc*) has been harassing me like 6:00am ca. time and using the same tactics I see in other complaints such as calling my neighbors to see if I am OK. Amy, calls non stop and according to the collection agency laws in TX which I found on the Tx. Attorney General web site says no,no. No you can not "use the telephone to harass debtors by calling anonymously or making repeated or continuous calls;". I am tired of Jim Steele and especially Amy. I feel sorry for these people that they choose this line of work.Nonetheless, s**** with this from the Attorney General web site:If you are being subjected to harassing, abusive, or fraudulent debt collection tactics by professional debt collectors, and you want to stop further contact with you, notify the collector in writing. Keep a copy of your letter and send the original to the debt collector by certified mail, "return receipt requested". It cost a little more but you will need the proof that they received it.Also, here is the information you will need for RCI.Rci - Recovery Concepts Inc.1925 E Belt Line Rd # 510Carrollton, TX 75006-5813 Phone: (972) 478-7858 Really, we should all do what I am going to do and file a complaint to Atty Gen Office. Here is the web site and it is fast and easy. http://www.oag.state.tx.us/index.shtmlJust click on the tab, Consumer Protection and then on the left side of the page, click on Debt Collection and read on. Then, toward the top of this page look for the tab "file a complaint". Click on it and then you can get a .pdf complaint form that you can print out and mail in. It fast and easy and only 2 pages long.Good luck!
This slimeball weasel called my friend twice this morning, waving the last 4 of her soc sec around like it was public knowledge; trying to collect a debt from her deadbeat ex-husband of 18 years ago using a bunch of abusive and threatining language! He wouldn't accept my call so he'd have to deal with someone man-to-man! Jim Steel, Man of lead! What a Slug! Next Stop: Attorney General's Office and then on the FCC and FTC!
Some guy called and said "Andrea"??? I told him he had the wrong phone number. He stated the full name. I told him the rror he made is that my address is similar to their address and before I could finish he ***g up on me. Odd that I decided to Google the RCI company with the 972 exc****e!What a devious company!
I received a call from Kelly Anderson looking for my neighbor. She said she didn't know if there was any construction in the area and had been trying to contact my neighbor without any luck. She asked me to get her info so I could deliver the messege on my neighbor. When I asked her how she got my number she said she got in online. I thought it was so****ing important from a friend until she gave me an 1-800-931-9638 number. I decided to go online to try to get any information before going to my neighbor just to find out this is a harassing debt collector company. I wont' deliver this messege to my neighbor.
Have received around 6 phone calls from this company asking for my brother-in-law. He does Not live or use our home phone number, so am not sure why they are harassing my husband and I. I have told them repeatedly that we have no number for them and that we want our number removed from their contact list. One guy stated that the only way we can have our number removed is if we help our brother-in-law pay them the money he owes them. I said no, we will not be paying someone else's debt, and a***n asked them to quit calling our number. He said, no and that he'd keep calling, because he thinks that I am being dishonest with him. What the***** kind of person does this company employ? I understand it is there apparent job to try to collect a debt, but will not excuse the behavior of this company, also they called the other morning after I asked them to stop at 7am, and woke up the whole house! They should have to still abide by the rules, and respect peoples privacy. How does one get a debt collector to quit calling you for someone else's debt?
Same as 972-478-7858 - 13 Oct 2009I received a call from a Sandra 1-8---931-9638 xt 240 who told me that she was trying to get in touch with my neighbor and they had been unable to reach him. She said she was concerned and wanted to know if I could leave him a note on his door to call her back. I thought it might be a family friend from out of town or somehting until she gave me the 1-800 number. I asked her how she got my information and she said they cross refrenced it on the internet. I pressed the issue and she shared this came from Anywho.com-I am not listed in reverse lookup or whitepages.com so this concerned me. She said that they did not know if there was construction going on in the area and they were doing personal business with my neighbor but had not been able to reach him in the past few days. I asked if this was a skip trace- she said she was calling from an attorney referral service-***? She as polite enough hence the reason I didn't freak out on her-but not sure why they think I care if my neighbor owes money-I wouldn't tell the a thing! Earn your money collector!Caller ID: 972-478-7858 Wake Forest, NC
Some guy named Tony called for my sister (who is mentally handicaped) he left a message the first time he called her. He told her to call back with her social security number to verify she was the correct person. I called back (as her) and without giving the social security number he proceeded to tell me that she owed over $400.00 to a tractor parts company in Texas. He said she wrote a bad check and it needed to be paid for with a cashier's check. I explained that she had never had a checking account because of her illness and that she had never been to Texas (We live in WI). He got mad and said I was just making excuses. He would procecute to the fullest extent of the law. He calls several times a week. We quit answering 972-478-7858, now he calls from a blocked number.
I had the very same call as the above person. Also asked for a neighbor. I tried to ask who they were but of course they wouldn't tell me so I **** up.
We received a call from a ***le who told me that she was trying to get in touch with my neighbor and they had been unable to reach him. She said she was concerned and wanted to knowif i could leave him a note on his door to call her back. I thought it might be a family friend from out of town or somehting until she gave me the 1-800 number. I asked her how she got my information and she said they cross refrenced it on the internet. I called back the number she gave me and it did not work, i then called the number on my called id and asked for her manager. He said yes, that is how they get information and had no problem with her calling me about my neighbor. He said that they did not know if there was construction going on in the area and they were doing personal business with my neighbor but had not been able to reach him in the past few days.
Just received a call from a nasty Jim Steele from this company. Says I owe a debt to Yellow pages that I never subscribed to. He was very nasty. I told him I am contacting the Attorney General and he ***g up on me. Two minutes later he called back to say he got the wrong person. Scare them with that. It may work. Then actualy call the attorney General and report them. If enough people comlain about this company, so****ing may be done about it.
Got a call from Jim Steele, says I owed yellow pages money. He had the wrong company buy had last 4 digits of ss#. After I ***g up, I called Attorney General office and Credit Bureau to file a complaint. He called back and said he had the wrong person. Be su****ious of this company!
I have recently received several messages from a Mark Anderson stating that my husband will be sued if he does not pay his bill. They make it sound so legit, please lock up those criminals before they take advantage of innocent people.

I got a call from this collection agency and even though I was not the person they were looking for, I found them to be very professional. I am sure that if you are the person they are sear****g for, of course you will complain. I haven't heard from them since they took my number out of thier system.
This guy threatened my wife and she lost her job I think I will do a lawsuit on them for violating Federal Law the guy Tony A** Hole called my wife boss and said she was a covering for her!!!!!
This guy named Tony Ricco keeps calling me about a debt that my company owes! The thing that makes me upset is that this isn't a personal debt, I just happened to be the one who signed for the merchandise. He's called me threatening me to put this on my credit report, he also threatened to put it on my wifes credit report. What really ****ed me off is that this guy had my social security number and he rattled off information about a few of my personal accounts. This is information that was never given to the company that he's calling to collect money for. It's a corporate account! The business he's trying to collect for never extended me a personal line of credit! They extended credit to the company that I work for, but this guy is harassing me. If anyone knows of any legal action that can be taken a***nst RCI please let me know.
We have s****ed receiving calls from this number since Fri. 2/8 by a guy using the name "'Tony Ricco". He has left messages on both of our business phones, and cell phones. He has been using the deceptive phone tactics by making calls to look like they are coming from our jobs, or our cell phones to one another. Only when answered, it is himl. He has left threatening messages about contacting my spouses supervisor to get a message to my wife, and then another message saying he was going to contact our next door neighbors to send them to our house to check on us and make sure everything is okay. (Yeah, right!) He is always claiming that he knows our social security numbers, our places of work, and anything else he can to scare us. We have contacted our attorney, and he has directed us to let Tony know to contact him. We have told Tony several times, and he won't listen, he just keeps calling every different number he can to harrass us. We also contacted the debt collector, and they have told us that they don't want to****ociate with this company anymore either. They are working with our attorney. They want RCI out of the picture because they claim they don't want to do that kind of business. And still Tony won't lay off! We're not even sure what he is expecting from us, we won't give him the time of day to talk to us. But he keeps leaving messages. We've even received a mailing on 2/10.
Yes****ay the called twice using their RCI number. The third time the guy s****ed my husband's work phone and said, "Hey where's my client's money?" I laughed and told him thanks for the phone call because now I'll be reporting him to the Attorney General then ***g up on him. They call on a daily basis despite being told to stop calling and contact me via snail mail. I'll be sending them a certified mail telling them to cease and desist on the phone calls and any further contact from them can result in a lawsuit from me for violating Federal law.
This guy threatened my wife
