Leave a CommentI too recieved a call from an individual who identified himself as "Leo Hernandez". He stated that he was calling from the Financial Crime Investigation department and to inform that there were 3 complaints filed a***nst me in Federal court alledging several counts of check fraud and theft for a loan that I alledgedly recieved, but failed to pay back. This appears to be their M-O, they call and try to frighten you into believing that you will face garnishment or arrest if you do not pay them money to clear up their false claim. The facts are these and can be verified by visiting ftc.gov...search for Fair Debt Collection.First of all, the caller must identify themselves and upon request, disclose contact information, i.e. address and phone number. "Leo" stated that he did not have an address or phone number...as if I were to believe he was not in a physical building speaking to me on a working phone.Secondly, the caller must provide written verification of the debt in question upon request. "15 or 16 emails" do not count as written correspondence.Third, a creditor can not legally arrest you nor can they garnish wages unless allowed by a court order. They may sue you of course if you fail to pay a legimate loan. But then they file with a court and you will be served with a formal summons to appear. So do not give them any person information more than they already have. Call their bluff, if they threaten to arrest you...then tell them you will wait for the police....if they threaten to sue you...then tell them you will wait for the court papers to arrive. Chances are they will **** up and nothing will ever happen to you.Finally...according to FTC regulation regarding Fair Debt Collection, a debt collector cannot threaten harm, nor can they threaten to arrest, nor can they use foul or abusive language. If any of these occur, it is likely a dead give away that they are criminals attempting to frighten you for money...
I just received a call from this number with the same kind of nonsense as described above. The first person I spoke with identified himself as John A***ham from Pittsburg PA and said his company was Financial Crime Scene Investigation, which I cannot find on the internet. After repeatedly telling this man I do not have any outstanding debt and asking for more information, he ***g up on me. My phone immediately rang displaying as "unavailable". This man said his name was Leo Hernandez, definitely not a Hispanic accent, and proceeded to go on and on about how he wanted to help me and refused to listen to my****ertion that I no outstanding debt. I just obtained my credit scores from the 3 big companies and was given an 800+. I guess I'll just wait to see if the police come to my door to arrest me. Weird.
This bunch ( in broken english, of course) told me that I am going to be charged with 3 fraud related crimes. I suuposedly had defrauded banks or so****ing. After being very stern with me he said that I seemed like a decent guy and maybe he could "fix" it for me. Then came the request for money and I ***g up on him. This guy had left atleast one somewhat threatening message earlier in the day.
