Leave a CommentI am in Texas. I got served for debt being collected by this Rausch, Sturm, Israel, Enerson & hornick firm around Christmas too. I filed a "general denial" on advice from an attorney friend. A court date of 3/3 has been set. After being served, I received a letter offering 2 settlement options and I do not have the financial means to do either option. i called them to offer to s**** paying $10 per month as an act of good faith, but they said they were only "authorized" to accept one of the 2 offers they made and they would just see me in court.I have done some reading and have learned through web posting by concerned consumers like me that this outfit is taking a strong-arm approach in many states. I have seen some discussion about wage garnishment and default judgments and have some questions:1. Should I try to negotiate with these guys or just wait for my court date and take my chances on the outcome?1b. When I filed my "general denial," per the instruction I was given, I stated they needed to validate the claim. The court date has been set but don't they have to provide validation of the debt before the trial? Did I ***** up calling them to discuss payment options - did this give them the "validation" they need if they recorded the call?2. What is the probability they will show up at the court date?3. If they do, what are the possible outcomes? Can they do anything besides get the judgment a***nst me in Texas?4. Can they garnish wages in Texas? (I have heard creditors cannot)5. Can they really get money right out of my bank account? How would they get access if I don't give it to them?6. Can the judge force me to settle for an amount that will make my financial situation much worse?7. Can I have more than 1 judgment a***nst me in Texas? (I have heard they cannot)8. Once this specific suit/debt is resolved, regardless of the outcome, will they simply file the next suit?9. How do I determine if they have the right to file a lawsuit in the first place? Reading some of the FDCPA stuff, it sounds like they may not have the right... and if they don't, what's my recourse to stop this circus?
BEWARE.. if you had a suit(papers served) in MN prior to 8/16/2005 contact atty gen L. Swanson this is the first date of licensing I can locate in MN public records. Prior to that date they were not licensed in Mn only WI & MI. Mn regulates dbt. collectors.. some statutes to review MN 332,303,571. They send garnishment summons with false info and wait for YOU to call and confirm, first contact the court to find out if they have proper paperwork to s**** garnishment and carry out legally. They did it to me they will do it to you. S**** a site dedicated to a civil case a***nst them and WRITE WRITE the atty. gen.

Me a***n, just called the court. No biggie. I had called the Rausch people too, and they wanted like $300 a month! I don't have that kind of $$. The collector wanted my bank info, visa number to make a payment over the phone. I said, hmm let me call you back and see what I can do.I filled out the papers I was served and got them notarized, and I can mail them certified. Don't hafta go to court yet. The court clerk said it'll take at least a year for the next activity. During which time I can try to save up.
Just got served with papers. At Christmas time! One of their schemes, to get someone upset at this time of year. But not me! Gonna turn the tables on them. Will report on this site how it turns out :D
I also get this number . This dedt collection send me my bill however they gave me my cover letter with my name on it. However they gave me someone elses bill . The funny thing a day later I got another letter saying they respect privicy . how ever im on disabilty health not good . or i would if I could pay attonary to go after them . for giving me some one elses information Knowing they proberly gave my stuff to another person also. These people are relentless. They call and as soon as I tell them not to call or take the number off the list they **** up. I am going crazy with them calling every single day!
Within approximately a couple weeks of having contact with these folks for a Citibank card I have not had in over 7 years, they s****ed garnishing 25% of my wages on a Tuesday and on Thursday of that same week they cleared out my checking account leaving me with absolutely NO money. I have been told that as a debt collector they can do whatever they want, but to me I can't believe this is legal that a company can completely clean you out after you are already paying them. They were always rude and unprofessional in any dealings I had with them on the phone, the morning after they cleared out my account I tried calling at 8:15 am and was told the gentleman I was looking for "was not in until 9:30 am and that it was kind of early for me to be looking for him". I ended up borrowing money from a family member to settle this debt and get them out of my hair. They ended up putting the money back in my checking account, but I will have to wait and see what happens with the money taken out of my paycheck on my upcoming paycheck.
well I was like the earlier person who had her checking deducted more then 25% of her pay and now I am sitting with no monies after being paid. contact Kara Bovee at the State of Minnesota Attorney Generals office and report this agency of Rausch, Strum,Israel and Hornik of who took over my debt from Target, and took the money out of checking account to pay them above and beyond what the actual debt was owed. THis company is out of Milwaukee, WI and on the east coast too, so it is unclear as to whether or not they have jurisdiction to even do business in MN. It is best to check with the BBB and attorney Generals office in MN website www.ag.state.mn.us to see if they are legite in MN . They call my house all the time, and never leave a message, best of luck -and yes we as comsumers need to be our best abvocates to educate each other too.
i am having a big time problem with Raush,Sturm,Israel.Enerson,and Hornik,,they sued us and have a judgement a***nst me and my husband.we did not even know about,they will not work with us on payments ,only payments they wil exept is 430 $ and we cannot aford that and i have filled complain with Attorney General office Lory Swanson and will see ,,,
This Company Rausch, Strum,Israel and Hornik buys debt from others at pennies on the dollar and then illeagally imorrally attempts to collect the "debt". They skirt the law in every way they can and even if they manage to collect from you they will absolutely attempt to collect the same debt a***n! BEWARE!! They use tons of different phone numbers and call day and night a***nst debt collection laws in EVERY state and fed laws
This number calls me several times a day and has done so for the past two months. It is an out of area number and we don't have long distance so I have not answered it EVER. They still continue to call. After reading the comments above, I guess there's not a way to make them stop!
They are the rudest most inconsiderate people! Don from this firm screamed at yelled at me on the phone!! I made payement arrangements. He told me to "shut up" and don't ever interupt him a***n!!! Rausch Sturm is a Junk Debt Buyer. As far as I have found out they are not even legally able to collect debts in Minnesota! i have contacted the MN Attorney General regarding them.........
I called to find out why and how they got me on their call list. The woman on the other end of the phone argued with me. I demanded to speak with her manager. She ***g up the phone I continued to call back, for three times she answered the phone and would not put me through to a manager. On of the times she transfered me to an emergency room of the local hospital. That is very sad. Did they really find humor in this? And I still haven't got to the manager, I guess there isn't one on sight.
I am getting calls on my cell phone on Sunday for debt collection. The office is not even open when I try and return a call. Why do they not answer back when I return a call on SUNDAY of all days. This is not an ethical way to collect debt when they are not even open.

Rausch, Strum,Israel and Hornik took over a debt from Cap One. In just a couple of months, they put a judgement on me, then now a wage garnishment. Who are these people? I have tried to get help with MN Attorney Gen Office. If there is anyone out there that has been having major problems with this agency. PLEASE contact Kara Bovee at the State of Minnesota Attorney Generals office and report this agency, if there are more of us out there that have been victimized by this agency and we can get together and report them, maybe we can stop them for their unfair practices. I tried to settle a debt with this # 1-414-604-7193 Rausch Strum Israel Hornick. They are suppose to be a debt collection company. They took a settlement right out of my checking account and now they will not give me a receipt for the courts. So I still have to take off work and go to court on an account I settled with these very unproffessional people. They call all hours very rude sometimes you say*****o and no one is there. If you ask a question they tell you that you do not know what your talking about.

I told her to remove us from their call list and she began arguing with me saying she didn't know who I was and that she could not remove the number from the call list.
