Another no answer on*****o, ***g up junk call
Matt I am in Texas. I got served for debt being collected by this Rausch, Sturm, Israel, Enerson & hornick firm around Christmas too. I filed a "general denial" on advice from an attorney friend. A court date of 3/3 has been set. After being served, I received a letter offering 2 settlement options and I do not have the financial means to do either option. i called them to offer to s**** paying $10 per month as an act of good faith, but they said they were only "authorized" to accept one of the 2 offers they made and they would just see me in court.I have done some reading and have learned through web posting by concerned consumers like me that this outfit is taking a strong-arm approach in many states. I have seen some discussion about wage garnishment and default judgments and have some questions:1. Should I try to negotiate with these guys or just wait for my court date and take my chances on the outcome?1b. When I filed my "general denial," per the instruction I was given, I stated they needed to validate the claim. The court date has been set but don't they have to provide validation of the debt before the trial? Did I ***** up calling them to discuss payment options - did this give them the "validation" they need if they recorded the call?2. What is the probability they will show up at the court date?3. If they do, what are the possible outcomes? Can they do anything besides get the judgment a***nst me in Texas?4. Can they garnish wages in Texas? (I have heard creditors cannot)5. Can they really get money right out of my bank account? How would they get access if I don't give it to them?6. Can the judge force me to settle for an amount that will make my financial situation much worse?7. Can I have more than 1 judgment a***nst me in Texas? (I have heard they cannot)8. Once this specific suit/debt is resolved, regardless of the outcome, will they simply file the next suit?9. How do I determine if they have the right to file a lawsuit in the first place? Reading some of the FDCPA stuff, it sounds like they may not have the right... and if they don't, what's my recourse to stop this circus?
Robo call three times a day for a man I do not know.
I get at least 4 calls a day from this phone number!! They waste my phone minutes, the first time I received the call they asked for a Kelly, I said they had the wrong phone number but they still keep calling and now when I answer, ***ody's there, they just leave voicemail messages! I wish I knew how to get them to stop calling!!!!!!
