I received a call today from this number. They did not give me their company name and went on about personal information about a payday loan from 4 years ago! They told me I had 2 hours to pay them or they were going to take me to court, file a misdemeanora***nst me for fraud, and have me pay double the amount that they said I owed. They refused to mail me anything in the mail as they stated they already had done so 30 days ago. They gave me an address that I lived at 4 years ago! Also, they said they were going to have to contact the post office to get a copy of an address forwarding..?? What?? I talked to a woman named DEBBIE SMITH at extension 124. She kept telling me that the business was not a collections agency, that it in fact was a law office. I probably talked to the same front desk guy who c****ed his voice 3 times, and then talked to 4 other women who kept transferring me. Debbie refused to send me conformation via MAIL of my account and proof that I owe money.. I then asked for their address. She kept asking me if i just wanted her fax number. FINALLY she gave me an address. 252 Chippeawa Buffallo NY 14202. She was very rude at the end and was stuttering after I told her she is in violation of the Fair Debt Collections Act. I asked a friend to investigate and it turns up that this place called BRIAN AND BENJAMIN LAW office is a SCAM!
Suzanne, remember that in America you have certain rights and obligations. I would ask you to please join the rest of us by making a complaint to the NY attorney generals office in Buffalo NY, and the FTC. Your complaint will help them with the investigation as I understand is already underway. Any victim of their fraud is eligible for up to 1000 dollars in damages if any monies are seized by the FEDS. The FBI is currently wire tapping these idiots, and so the case is developing smoothly. If you register your complaint, you may be eligible for the damages sought after they are captured and prosecuted. GO to the attorney general's website for the NY state, and notice that Cuomo has shut down dozens of illegal collection agencies and confi****ed bank accounts totalling millions of dollars. They are currently being prosecuted in NY, and it doesnt matter where you live to be eligible for a complaint. Calling across the state lines has caught the interest of the US attorney's office as well. So please make your complaint official instead of just blogging it here. I hope this helps you.
I received a call from this number and was threathened I needed to pay $800 to these people in an hour or I would be arrested and taken to jail. I have MS and do not need this stress. After more investigation we found out they are fraud. My credit report is good. Has no debt owned to anyone. How do I stop the calls? They have now s****ed to call my parents phone trying to get monies. Finally got Jan Allan, the caller, to give us a name. It is Brian and Benjamin Law offices. To me, they are the criminals. Stop harrassing honest people.
Chris, you cant write a cease and desist letter to a company that wont give out their address. You were smart to report them immediately. Please report them to the FTC as well, and to Attorney General Cuomo's office. Your help is appreciated in helping us with this investigation. There are currently ***dreds of complaints a***nst Bryant and Benjamin Law Center, and you are not the only one that was told that they cannot name the Lawyer in charge for fear of ***** threats. That is proof that they are full of it. You did your homework, and your information is useful. Make sure you look them up and make comments on other blog sites like this one. You can google the name to lead you to 1-800 notes. It helps consumers beware of their intentionally fraudulent bill collecting practices. They have at least 10 different numbers, and c****e the names of their "investigators" frequently. They were jw and****ociates, and NRG out of buffalo. The Bryant and Benjamin Law Center is who they told me who they were. Referencing a payday loan from 4 years ago. They stated on my answering ma****e that they received a complaint from PaydayYes.com and it is being processed as bank fraud and passing a bad check. Also said that if I did not take care of it immediately I would be arrested and brought in front of a judge. A few years ago I DID have a few payday loans. I got out from under it, which took me almost a year. So I did not know if there was one I missed, but I told her that I needed to protect myself. I am married with 5 children, and without some type of validation I was not just going to give them 1000 dollars. I asked for them to mail so****ing to me, and she said that if they did that by the time it got to me house I would be in court. So they sent me an e-mail with a payment schedule. The email (I'm not kidding) came from [email protected]. I also asked her straight if there were a law firm. She said yes. This is important, because this is a direct violation of the fair debt collections act. If these people call you, record the conversation and ask this question specifically, as debt collection agencies are not allowed to misrepresent themselves as law firms. I asked her for the name of a lawyer on staff so I could look them up with the New York State Bar. She said she was not allowed to give them over the phone because the lawyers would receive ***** threats. I called the Attorney General to file a complaint, this is difficult because regulation of these companies is virtually impossible. Register one anyway, with the Attorney General of New York. Here is the scoop on them, though. They used to be Prescott Barnes, then c****ed their name to Bryant and Benjamin. they are NOT a law firm, they are a debt collector and are bound by the laws governing debt collection. That means they need to adhere to the fair debt collections act. Look it up. If they tell you that they will send the police to your house, do NOT be afraid. They CANNOT DO THIS. Debt collection is by definition a civil matter. People are not arrested for civil matters. The only thing they can do is file a lawsuit a***nst you and sue you. If possible, record any and all communications with them, as they will repeatedly violate the fair debt collections act, and you can use this to either reduce or eliminate any debt you MIGHT owe. I say MIGHT, because I found out later that I had indeed paid this loan off more than 3 years ago, and they were just trying to intimidate me into handing them money. Know your rights, and do not hand over your hard-earned money to someone who is willing to lie and be belligerent on the phone. That is how they make their money. If the call, you should immediately send a cease and desist letter by certified mail. This means they MUST stop calling you. Your debt (if it is real) will still be owed, but they are bound by law to stop the phone calls. They are also not allowed to contact you at work if they know it will be detrimental. Keep track of your credit report, and always ask for so****ing through the mail. If they are unwilling to send you so****ing, or unwilling to give you information about their company, so****ing is up!
Today is December 9, 2010...I received a phone call from Brian and Benjamin Law Center stating that they need my statement to put on file or so****ing. They have to give me court date for me to go to court...because I owe some Payday Loan $500. It was a lady didn't get her name..I told her I was going to record the phone call she said, "Who gave you rights to do that"..I told her, I did..it's my phone and you're calling my home phone I can do whatever I want with this phone call. She said, okay, no thank you. These people been harrasing me...I want to report them. And they need to stop calling my house.
Some woman left me a voice message at my work stating they have a legal matter that needs to be addressed with me. That Brian and Benjamin paralegals have called me numerous times trying to handle this situation. She stated if I do not call her back today then they were going to take me to court even gave a record number that make it seem like it is the court case number. I have no idea who these people are and can't find any information about them. Not sure if I should call them back or not.

I got a call looking for my ex husband that I have even spoken to in nearly 30 years. I can't remember for sure (too flabbergasted at why they were calling me) but I remember Law Center and the Brian & Benjamin sounds right. They said they would remove my name as a possible relative.
I just got a call from this number. Said his name is Mr (yup, he said Mister-weird) Willaim Ellington calling on behalf of Barnes & Stewart reguarding a physical complaint a***nst my husband. We need to call & make a statement & they would give us a 'chance to make voluntary res***ution'! Said to call 877-285-4919 & Ext 108. The call was made from Buffalo NY (we live in the midwest). This is BU***HIT people!!!!
Called and said they were Brian and Benjamin Law Center. I called back they said they never called us and our name was not in their data base. I told them, "I just hit redial and you answered" They said "thank-you" and ***g up. The phone reverse look-up says it is a landline in Buffalo, New York. There is no Brian and Benjamin Law Center in Buffalo, New York. It doesn't even come up on Google.
